Due to the problems arising with how projects are delivered, either due to poor specification, poor administration and management or poor performance on the contractor’s behalf, there is well founded need for achieving resolution of contentious contract issues before costly litigation is entered into.
The role of a technical expert is one where technical advice can be provided after evaluating all the relevant facts at hand. This advice comes at arm’s length and is usually required where a stand-off exists between the technical experts from the two parties.
Whilst most contracts allow for several means of dispute resolution, the role of technical expert can be used in assisting contract arbitration, mediation, determination and ultimately litigation.
The key attributes are the ability to grasp complex processes, the ability to explain complex issues in simple everyday language, a thorough understanding of the Conformed Contract conditions and the ability to get to the ‘heart of the matter’.
Campbell Dynamics has experienced personnel who bring to the table the following:
- Strong understanding of the General Conditions of Contract of all relevant Australian Standards (eg AS 2124,2125,2127, 4300, 4901, 4902,4905,4911 to name just a few)
- Being thorough and disciplined in the evaluation process
- Experience in providing ‘level-headed’ advice in volatile environments
- Strong skills in conflict resolution and facilitation
- Experience in contract suspension
- Experience in the formulation of lateral mitigation strategies
- Experience in providing guidance to insurance companies on potential claims
